Tootle Win Tribunal Case Against Former Employee

"The past 12 months have been a long period for the company and its directors and hardworking staff as we fought to defend our decision to lawfully dismiss Mr James on the grounds of gross misconduct."
Spokesperson for Tootle

Digital car selling platform, Online Auto Sales Ltd, trading as Tootle, has won its tribunal case against former, dishonest employee, Spencer James [30, Windsor, Berkshire].

James took the company to a tribunal for unfair dismissal, where the case was heard in public and dismissed at Victory House in Kingsway on November 22 and 23, 2018.

Tootle successfully defended its decision to terminate James’ employment on the grounds he wrongfully added Mike Bishop operating under a false name and address, formerly of Mike Bishop Cars.com, now trading as Black Barn Automotive LtdBerkshire, to the platform’s car dealership network, without following the correct company vetting procedure. Bishop has been subject to a Police investigation which is currently under review.

Tootle has created stringent vetting procedures for all dealers and resellers that utilise its platform for the protection of consumers, of which both Bishop and Black Barn Automotive did not meet.

A spokesman for Tootle confirmed: “Tootle is dedicated to transparency and honesty to ensure the best possible experience for consumers and dealers, where only pre-vetted and reputable dealers are able to utilize the platform.”

“The past 12 months have been a long period for the company and its directors and hardworking staff as we fought to defend our decision to lawfully dismiss Mr James on the grounds of gross misconduct.”

“The firm has now been rightfully vindicated and with the tribunal ruling that we acted properly in both our disciplinary processes and subsequent decision to terminate Mr Spencer’s employment with us on November 16, 2017.”
